Terms of Service – Reliable Home Renovation Home Care Plans
By purchasing or enrolling in a Reliable Home Renovation Home Care Plan, the customer agrees to the following terms and conditions.
1. Monthly Subscription
Home Care Plans are recurring monthly service subscriptions. The selected plan will automatically renew and the payment method on file will be charged the applicable subscription price according to the billing schedule disclosed at checkout, unless the subscription is canceled.
Enrollment in a Home Care Plan provides access to the service time and benefits specifically included in the selected plan. It does not constitute insurance, a home warranty, or a guarantee that all repairs, maintenance needs, systems, appliances, or conditions at the property will be repaired or replaced.
2. Included Service Time
Each Home Care Plan includes only the amount of service time, services, and benefits stated in the description of that plan at the time of purchase.
Service time is measured based on the time reasonably required to perform the requested work at the property. If more than one technician is assigned to a job, service time may be calculated based on the combined labor time of the technicians assigned to the work.
Work requiring additional time beyond the customer’s available plan hours may be scheduled separately and may result in additional charges, subject to customer authorization.
3. Scope of Services
Home Care Plans are intended for routine handyman services, minor repairs, maintenance, installations, adjustments, and similar residential services that Reliable Home Renovation is qualified and reasonably equipped to perform.
Reliable Home Renovation reserves the right to decline or discontinue any requested work that is unsafe, outside the scope of the selected plan, beyond the company’s qualifications, requires specialized licensing or equipment, requires permits or inspections not included in the service, or cannot reasonably be completed under the circumstances.
Larger projects and work outside the Home Care Plan may be quoted separately.
4. Materials, Parts, Permits, and Additional Costs
Unless specifically stated otherwise in the selected plan, materials, replacement parts, fixtures, permits, inspection fees, specialty equipment, rentals, disposal fees, and third-party services are not included in the monthly subscription price.
Any additional charges requiring customer payment will be communicated and authorized before the applicable additional work is performed, as required by applicable law.
5. Customer-Supplied Materials and Products
Customers may provide their own materials, fixtures, appliances, or products when appropriate.
Reliable Home Renovation is not responsible for manufacturing defects, missing components, incorrect dimensions, incompatibility, product failure, inadequate manufacturer instructions, or other defects or limitations of customer-supplied products, except to the extent damage is caused by Reliable Home Renovation’s own negligent installation or workmanship.
Additional time required because a customer-supplied product is defective, incomplete, incompatible, or incorrectly sized may use available service time or require an additional charge with customer authorization.
6. Scheduling and Availability
Customers must contact Reliable Home Renovation or use an available scheduling method to request service.
Subscription membership does not guarantee a particular appointment date, appointment time, technician, or immediate service.
Appointments are subject to technician availability, location, weather, materials, job requirements, and other reasonable scheduling considerations.
Reliable Home Renovation may reschedule an appointment because of weather, emergencies, unsafe conditions, employee availability, material delays, or circumstances reasonably beyond the company’s control.
7. Customer Rescheduling, Cancellation, and Access
Customers should provide at least 24 hours’ notice when canceling or rescheduling a service appointment whenever reasonably possible.
The customer is responsible for providing safe and reasonable access to the property and work area at the scheduled appointment time and for securing pets and removing unreasonable obstructions from the work area.
If work cannot reasonably begin or continue because access is unavailable, conditions are unsafe, the customer is not prepared for the scheduled work, or required customer-provided materials are unavailable, Reliable Home Renovation may reschedule the service.
8. Existing and Hidden Conditions
Reliable Home Renovation is not responsible for pre-existing conditions or concealed defects that could not reasonably have been identified before work began, including concealed water damage, rot, mold, structural defects, pest damage, defective wiring, defective plumbing, code violations, previous improper repairs, or other hidden conditions.
If an unexpected or concealed condition is discovered, work may be stopped until the condition can be evaluated. Any additional work necessary to address that condition will be discussed with the customer and, where applicable, separately authorized or estimated.
Nothing in these Terms excludes responsibility that cannot legally be excluded under applicable law.
9. Unused Service Time and Rollover
Unused monthly service time may roll over for up to two (2) months, subject to the terms of the customer’s Home Care Plan.
Rolled-over service time must be used within two months after the month in which it was originally earned. Service time remaining after the applicable rollover period expires and will not continue accumulating.
Unused or expired service time has no cash value, is not transferable to another customer, and is not redeemable for cash except where otherwise required by applicable law.
10. Workmanship
Reliable Home Renovation will perform services in a professional and workmanlike manner consistent with the scope of the authorized work.
If the customer believes work performed by Reliable Home Renovation has a workmanship-related issue, the customer should notify Reliable Home Renovation promptly and provide a reasonable opportunity to inspect the work.
Manufacturer warranties on materials, fixtures, appliances, and products are provided by the applicable manufacturer and are separate from Reliable Home Renovation’s workmanship obligations.
This section does not limit any rights or remedies that cannot legally be waived under applicable law.
11. Additional Work and Customer Authorization
Work outside the selected Home Care Plan, work exceeding available service time, or work requiring additional materials or charges may be quoted or billed separately.
Reliable Home Renovation will obtain customer authorization for additional charges when required before performing the additional work.
Approval may be documented through a written estimate, invoice, electronic message, email, text message, electronic approval, or another legally permitted method.
12. Recurring Payments and Failed Payments
By purchasing a recurring Home Care Plan, the customer authorizes recurring charges according to the price and billing frequency disclosed at checkout.
If a scheduled payment is declined, reversed, disputed, or otherwise unsuccessful, Reliable Home Renovation may suspend future Home Care Plan services until the account is brought current.
Reliable Home Renovation will not intentionally charge a customer for services or additional work that the customer has not ordered or authorized.
13. Customer Cancellation of Subscription
Customers may cancel their Home Care Plan before the next applicable renewal in accordance with the cancellation method provided through the store, subscription management system, or by contacting Reliable Home Renovation.
Cancellation stops future recurring charges after the effective cancellation date but does not automatically create a refund for a billing period that has already begun or for services already provided, except where a refund or cancellation right is required by applicable law.
Cancellation of a subscription does not convert unused service time into cash.
Nothing in these Terms limits any statutory cancellation rights that may apply to a particular transaction.
14. Cancellation or Discontinuation by Reliable Home Renovation
Reliable Home Renovation may discontinue a Home Care Plan program or terminate an individual customer’s subscription by providing at least thirty (30) days’ written notice, except where immediate suspension or termination is reasonably necessary because of nonpayment, fraud, threats, harassment, unsafe conditions, illegal activity, repeated material violations of these Terms, or other serious circumstances.
No recurring subscription charges will be made for billing periods beginning after the effective termination date.
Service time previously paid for and still valid on the effective termination date may be used for up to sixty (60) days following company-initiated termination, subject to scheduling availability and these Terms, unless termination resulted from circumstances that make continued service unsafe or unlawful.
If Reliable Home Renovation cannot reasonably provide valid prepaid service time following a company-initiated termination, the company may provide an appropriate prorated refund or other remedy as required by applicable law.
15. Changes to Plans, Pricing, and Terms
Reliable Home Renovation may modify future plan pricing, included services, service limits, rollover rules, or these Terms.
Material changes affecting an existing customer’s future subscription periods will be communicated in advance as required by applicable law.
Changes will apply prospectively and will not authorize retroactive charges for services that were not previously agreed to.
If a customer does not wish to continue under revised terms, the customer may cancel future renewals before the revised terms take effect, subject to applicable law.
16. Property Conditions and Safety
Reliable Home Renovation may stop, postpone, or decline work when the work area presents an unreasonable safety risk, contains hazardous or potentially hazardous materials or conditions, requires specialized remediation, or otherwise cannot reasonably be serviced safely.
The customer is responsible for informing Reliable Home Renovation of known hazards or conditions that could materially affect the requested work.
17. Damage and Limitation of Responsibility
Reliable Home Renovation is responsible for damage to customer property to the extent caused by the company’s negligence or legally actionable misconduct, subject to applicable law.
Reliable Home Renovation is not responsible for damage resulting from pre-existing defects, concealed conditions, normal deterioration, defective customer-supplied products, inaccurate information supplied by the customer, unauthorized modifications by others, or circumstances outside the company’s reasonable control, except to the extent otherwise required by law.
Nothing in these Terms is intended to waive or limit rights, remedies, warranties, or liabilities that cannot legally be waived or limited.
18. Photos and Documentation
Reliable Home Renovation may photograph or otherwise document the work area before, during, and after service for estimating, documentation, quality control, dispute resolution, and business recordkeeping purposes.
Photos identifying a customer’s private property will not be used for public advertising or marketing without appropriate permission when such permission is required.
19. Home Solicitation and Other Statutory Cancellation Rights
Certain transactions may provide customers with additional cancellation rights under federal, state, or local law.
Where the Ohio Home Solicitation Sales Act or another applicable law provides a customer with a statutory cancellation period or requires a specific cancellation notice, those legal rights and requirements will apply notwithstanding anything inconsistent in these Terms.
20. Governing Law
These Terms are governed by the laws applicable in the State of Ohio, without limiting any mandatory consumer protections available to the customer.
21. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
22. Entire Agreement
These Terms, the selected Home Care Plan description, applicable checkout disclosures, authorized estimates or work orders, and any other written terms specifically agreed to by the customer constitute the agreement applicable to the Home Care Plan and authorized services.
No provision of these Terms eliminates rights that cannot lawfully be waived.
